An analysis of IPR’s challenges in the protection of artistic creativity in India

Abstract: This research paper critically examines the challenges associated with protecting artistic creativity under India's Intellectual Property Rights (IPR) regime, specifically focusing on copyright law. Despite a comprehensive legal framework, including the Copyright Act of 1957 and its subsequent amendments, artists in India continue to face significant hurdles in safeguarding their works. The study explores various issues, such as digital piracy, lengthy and expensive legal procedures, lack of awareness, and weak enforcement mechanisms, which collectively undermine the effectiveness of IPR protection.Through secondary data from government reports, academic research, and statistical analyses, this paper identifies trends in copyright infringement, the disparity in IPR awareness among different regions, and the gaps in enforcement that hinder effective protection. The paper also discusses the impact of globalization and digital technology, which have transformed the artistic landscape but also created new avenues for unauthorized use and distribution of creative works.
